RULES OF THE ONLINE SHOP "ZINGPACK" 2016.05.11
I. General provisions
These Regulations set out the rules for using the online store at www.zingpack.com.pl. These Regulations are the regulations referred to in art. 8 of the Act on providing services by electronic means. The Internet shop, operating at www.zingpack.com.pl, is run by ZING Sp. z o.o. with its registered office in Cracow, ul. Kocmyrzowska 13A, registered in the Register of Entrepreneurs maintained by the District Court for Kraków Śródmieście, XI Commercial Division of the National Court Register, under the number KRS 0000070350, tax identification number 945-18-15-789 (hereinafter referred to as "ZING"). These Regulations specify in particular: a) rules of registration and use of the account within the online store; b) terms and conditions of electronic submission of Orders within the online store; c) rules of conclusion of Sales Agreements with the use of services provided within the Internet Store. d) the mode of complaint procedure within the online store. Use of the Internet shop is subject to the condition that the IT system used by the Client is used by the following minimum technical and configuration requirements necessary to work with the IT system used by the Service Provider: a computer running Windows, Linux, IOS or other operating system. for Android or iOS platform and one of the browsers: a) Internet Explorer (version 9 or higher), b) Firefox (version 38 or higher), c) Chrome (version 31 or higher) d) Opera (version 10 or higher) e) Safari (version 6 or higher); f) Android Browser (4.1 or higher) g) Chrome for Android (version 42 or higher). In order to use the online store, the customer should have access to a computer station or terminal, with access to the Internet. In accordance with applicable laws, ZING reserves the right to restrict the provision of services through the Online Shop to persons over the age of 18 years. In this case, potential customers will be notified about this. Persons under the age of 13 may only use the Internet Shop through their legal representatives. In the case of persons over the age of 13 but not under 18 years of age, the use of the Internet Store requires the consent of the statutory representative. Customers can access these Terms at any time via the link located on the main page of https://zingpack.com.pl/Regulations-cterms-eng-18.html and download and print it. Information on the Goods, which is provided on the website of the Shop, in particular their descriptions, technical and service parameters and prices, constitute an invitation to enter into a contract within the meaning of art. 71 of the Civil Code.
Terms used in the Regulations mean:
Client - a natural person, legal person or organizational unit not a legal person, whose special provisions confer the legal capacity to place an Order within the Store;
Wholesaler - A customer who is a natural person, legal entity or organizational unit not a legal person, whose special provisions confer legal capacity, and who makes a wholesale order within the ZingPack Online Store directly in connection with a business or professional activity. Obtaining the status of a wholesale customer is possible by sending the registration form via the Shop or by e-mail to email@example.com with the necessary registration documents of the Customer asking for the above mentioned status. A wholesale customer may apply for a credit limit. The decision to grant the limit is fully dependent on the Shop. Notices and the appropriate reasoning should be sent to the e-mail address mentioned above. Civil Code - Act of 23 April 1964 (Journal of Laws No. 16, item 93, as amended); Regulations - these Terms of Service by electronic means within the ZingPack Online Store; Online Shop - an online service available at www.zingpack.com.pl, through which the Customer may, in particular, place an Order; Goods - products presented in the Internet Shop; Sales Agreement - Contract of Sale of Goods within the meaning of the Civil Code, concluded between ZING and the Customer, concluded with the use of the Shop's Internet service; Consumer Rights Act - Law of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827); Act on the provision of electronic services - Act of 18 July 2002 on providing services by electronic means (Journal of Laws No. 144, item 1204, as amended); Order - statement of the will of the Customer, aiming directly at the conclusion of the Sales Agreement, specifying in particular the type and number of the Goods. Wholesale contract - statement of the will of the Customer, aimed directly at the conclusion of the Sales Agreement, specifying in particular the type and number of the Goods. Taking into account specific purchase conditions established individually when approving a customer registration application, ie: minimum wholesale order value in PLN net, rebate threshold (percentage / volume).
The condition to start using the Online Store is to register within it. Registration is made by completing and accepting the registration form, made available on one of the Shop pages. The condition of registration is the consent of the content of the Regulations and the personal data marked as mandatory. Submission of personal data indicated in sec. The above 3 is voluntary, but is required to use the Online Store. Removal of this data is possible by de-registering from the Store, in accordance with the procedure described in paragraph 8 below. The customer's personal data is ZING. Your personal information will be processed solely for the purpose of providing the Internet Store and the performance of the contract for the purchase of goods through the Internet Store. Customer may agree to use such data for purposes of. The customer has access to their personal information and the ability to modify them by logging into their account at the Store. At Customer's request, it is possible to deregister it from the Store at any time, without giving reasons. ZING may deprive Customer of the right to use the Internet Store and may restrict its access to some or all of the resources of the Online Shop, with immediate effect in the event of Customer's breach of these Terms and Conditions, and in particular when Customer: has made, during the online registration, inaccurate, inaccurate or outdated information, misleading or infringing on the rights of third parties, has committed through the online store infringement of personal interests of third parties, in particular the personal interests of other customers of the online store, Other behaviors that will be considered by ZING to be unconstitutional or general Internet usage rules or to disqualify ZING. In order to ensure the safety of the transmission of messages and data in connection with the services provided within the Site, the Online Shop shall take technical and organizational measures appropriate to the degree of security of the services provided, in particular measures to prevent the unauthorized access and modification of personal data transmitted on the Internet. The Client is obliged in particular to: failure to provide or transmit unlawful content, such as content that promotes violence, defames or infringes on personal and other rights of third parties, Use of the Online Shop in a way that does not interfere with its operation, in particular by using specific software or devices, Do not take action such as: distributing or posting unsolicited commercial (spam) information in the Online Shop; to use the Online Store in a way that is unobtrusive for other customers and for ZING, Use of any Content contained within the Online Shop protected by copyright only in the area of personal use, use of the Internet Store in a manner consistent with the law of the Republic of Poland, the provisions of the Regulations, as well as the general rules of using the Internet. IV. Procedure for conclusion of the Sale Agreement In order to enter into the Sale Agreement via the Internet Store, please go to the website www.zingpack.com.pl, select the goods or goods offered, taking further technical steps based on the displayed messages and the information available on the website. The ordering of the ordered goods by the Customer is made by adding them to the cart. When ordering - until the "I order" button is pressed - the customer has the possibility to modify the entered data and to select the Goods. To do this, you must follow the displayed messages and the information available on the website. Once the Customer has made use of the Web Store all the necessary data, a summary of the Order will be displayed. The summary of your Order will include information on: a. the object of the contract, b. unit and total price of ordered products or services, including delivery costs and additional costs (if any); c. selected payment method, d. the chosen delivery method, e. delivery time In order to send the Order, it is necessary to accept the content of the Regulations, provide the personal information marked as mandatory and press the button "I order with payment". Sending a Order is a statement of intent to conclude an Agreement with ZING, in accordance with the content of the Order and the Order. Once the Order is placed, the Customer receives an email containing the final confirmation of all relevant elements of the Order. The e-mail message referred to in item 7 above is sent immediately after placing the order by the Customer. The contract is treated as concluded with the receipt of the e-mail message referred to in item 7 above. The sales contract is in Polish.
Delivery of Goods is limited to the territory of the Republic of Poland and takes place at the address indicated by the Customer during the Order submission. Delivery of ordered goods is done by courier via DHL Express (Poland) Sp. z o. o. or via another Carrier, ie a specialized external courier or forwarding company, authorized to carry out business activities in the field of courier services (reception, delivery, delivery service, etc.). The delivery deadline is 14 working days from the date of dispatch of the Order. Confirming, securing, making available and confirming to the Customer significant provisions of the Contract for the Sale of Goods shall be made by sending to the Customer the given e-mail address and by attaching the Confirmation Order, the Order Specification and the VAT invoice.
VI. Prices and methods of payment
Commodity prices are quoted in Polish zloty and include all ingredients, including VAT (with a premium), customs and all other ingredients. There is a special situation where the amount to be paid in the order may differ from the amount on the FV by 1 grosz. This is due to the system of calculating the VAT by the shop system operating on the software provided by IAI Shop S.A. and the system of ZING Sp. z o.o. to issue sales documents.
VII. Right of withdrawal (consumer)
The consumer is entitled to withdraw from this contract within 14 days without giving any reason in accordance with art. Article 27 of the Law of 30 May 2014 on Consumer Rights (Journal of Laws of 2014, item 827) The expiry date shall expire 14 days after the date on which the consumer took possession of the item or in which a third party other than the carrier and indicated by the consumer entered the property. To keep the withdrawal deadline, it is enough for the consumer to send information about the exercise of his right to withdraw from the contract before the expiry of the withdrawal period. Consequences of withdrawal As a result of withdrawal from this contract, all payments received from the consumer will be returned, including the cost of delivery of the item (except for additional costs resulting from the consumer's choice of delivery other than the cheapest usual delivery method offered by ZING) immediately. Event no later than 14 days from the date on which ZING was informed of the consumer's decision to exercise the right of withdrawal from this contract. A ZING payment will be made using the same payment methods as used by the consumer in the original transaction, unless the consumer explicitly agrees to another payment; In no event will the Consumer pay any fees in connection with this return. ZING may withhold payment until the item is received or until proof of return is provided, whichever occurs first. In the event of withdrawal, the consumer is obliged to return the goods immediately, ie no later than within 14 days of the date ZING was informed of the withdrawal. It is the responsibility of the consumer to bear the costs of reducing the value of the goods as a result of using it in a manner other than necessary to establish the nature, characteristics and functioning of the goods.
VIII. Complaints regarding Goods
ZING as the seller is obliged to provide the customer with goods without defects. As a salesman, ZING is responsible for the customer being a consumer within the meaning of art. 22 of the Civil Code, in respect of warranty for defects in the scope defined in the Civil Code, in particular Art. 556 and subsequent Civil Code. ZING does not warrant the sale of goods. Liability of ZING as a seller for defects of goods against a non-consumer Customer within the meaning of art. 22 of the Civil Code, is governed by the General Conditions of Sale ZING available on our website at http://www.zing.com.pl/uploads/sfMediaBrowser/pdf/ogolne-warunki-sprzeda-y-zing.pdf, the content of which is an integral part of the contract concluded with the Client referred to in this point. Complaints arising from infringement of the Client's rights guaranteed by law, or pursuant to these Terms and Conditions, should be addressed to firstname.lastname@example.org. ZING undertakes to consider each complaint within 14 days, and if it were not possible, to inform the customer during this period, when the complaint will be processed and the next steps of the complaint. From January 2016, the European Consumer Dispute Resolution System is available: http://ec.europa.eu/consumers/odr is a platform for an online dispute resolution system between consumers and businesses at EU level (ODR platform). The ODR platform is an interactive, multi-lingual website with a comprehensive service for consumers and businesses seeking out-of-court settlement of contractual disputes arising from an online sales contract or service contract.
IX. Complaints regarding the provision of services by electronic means
ZING takes steps to ensure that the Store is fully operational, to the extent that it is based on current technical knowledge and undertakes to remove, within a reasonable time, any irregularities reported by Customer. The customer is obliged to immediately inform ZING of any irregularities or interruptions in the functioning of the Internet Shop. Irregularities related to the functioning of the Shop, the Customer may write in the address indicated in point. § VII of these Regulations, by e-mail to email@example.com or by telephone at the indicated phone number on zingpack.com.pl. In the complaint, the Customer should provide his / her name, mailing address, type and date of occurrence of anomalies related to the functioning of the Store. ZING undertakes to process any complaint within 30 days, and if it is not possible, to inform the Customer during this period when the complaint will be processed.
X. Final provisions
These terms and conditions are made available free of charge to Customers / Users through the zingpack.com.pl online store website before the conclusion of an electronic service contract, and the possibility of obtaining, reproducing and preserving the contents of the Regulations by means of a computerized data system used by the Customer / . ZING is authorized to amend the Terms at any time. The amendment of the Terms and Conditions does not require prior notice to users and is binding and therefore binding at the time of publication of the new version of the Terms and Conditions on the website of zingpack.com.pl. These Regulations contain the following attachments: Appendix 1 - Notice of the right of withdrawal; Appendix 2 - withdrawal form; Client / User hereby agrees that in the event of any action or omission of damage to the Service Provider or other third party in connection with breach of the Terms and Conditions, he / she is obliged to cover damage as well as lost profits and cover the costs of claiming compensation by the aforementioned entities. Any disputes arising out of the use of the web site will be resolved amicably by the parties, and in the absence of an amicable resolution by the local court competent for the Service Provider. In matters not regulated in these Regulations, the provisions of Polish law, in particular the Act of 23 April 1964, Civil Code (Journal of Laws of 1964, No. 16, item 93, as amended), and in the case of Clients The provisions of the Act of 30 April 2014 on Consumer Rights (Journal of Laws of 2014, item 827) as well as the provisions of the Act of 18 July 2002 on providing services by electronic means, the Telecommunications Law, ( Journal of Laws No. 144, item 1204, as amended), as well as the provisions of the general terms and conditions of sale of Zing to include in the content of the contract, CLIENT, as knowing their content, agrees.
